Les intermittents du spectacle : une exception menacée ?

En pleine crise de la dette, la pilule devient, pour les partisans de la rigueur, difficile à avaler. Le déficit du régime d’assurance-chômage des artistes et des techniciens du spectacle s’élevait en 2010 à 1,031 milliards d’euros. Dans son rapport annuel, la Cour des comptes parle d’une situation qui « dans le contexte actuel des finances publiques n’est pas soutenable ». Pierre-Michel Menger, directeur de recherches au CNRS et à l’EHESS et auteur de l’ouvrage « Les intermittents du spectacle. Sociologie du travail flexible » (Ed. de l’Ehess), observe que « le déficit est structurel depuis longtemps. Depuis les années 1990, les dépenses annuelles d’indemnisation ont été de 6 à 9 fois plus importantes que les recettes issues des cotisations des employeurs et des salariés. Les modifications successives du régime n’ont eu pour effet que de ralentir la croissance du déficit, au prix de conflits très vifs. Quand, au plan national, le problème des déficits publics et du déséquilibre des comptes sociaux est posé à tous, il est logique de s’inquiéter de toutes les composantes du déséquilibre. » Une fois ce constat établi, comment faire évoluer le régime ? C’est là que naissent les crispations. La Cour des comptes propose notamment de séparer artistes et techniciens. Les premiers resteraient intermittents et les seconds rejoindraient les travailleurs intérimaires. Cette distinction est motivée par le fait que les techniciens n’auraient pas besoin d’indemnités pour pouvoir s’exercer et répéter, comme c’est le cas des artistes. Cette mesure – encore hypothétique – crée déjà une bronca chez les techniciens, mais aussi chez les artistes, comme nous le confirme un musicien classique : « Ce sont les techniciens qui nous ont toujours protégés. Ils sont les garants du système. Si un politique veut remettre en cause l’intermittence, les techniciens de l’audiovisuel brandissent la menace d’un arrêt de travail, stoppant toute diffusion à la télévision. Nous n’avons pas le même pouvoir. Je crains malheureusement que si l’intermittence ne concerne que les artistes, nous ne ferons pas long feu. »
« Une chasse à la fraude illusoire »
De son côté, Pierre-Michel Menger rétorque qu’« une chose est de constater que le marché du travail des techniciens est plus prévisible et moins déséquilibré que celui des artistes, autre chose est de redistribuer les cartes de la flexibilité. Le monde des techniciens de spectacle est assez complexe. Les réalisateurs de cinéma sont assimilés à des cadres techniques, mais ce sont bien des artistes auteurs. Enfin, il serait intéressant de mieux connaître le recours à l’intérim, dont le régime assurantiel est lui-même très déficitaire. » La Cour des comptes dénonce par ailleurs dans son rapport le phénomène des « permittents ». Certaines structures, dans le domaine de la culture et de l’audiovisuel, emploient en effet des intermittents de façon permanente au lieu de les engager en CDD ou CDI. Pour Pierre-Michel Menger, « l’utilisation du CDD d’usage donne lieu à des abus régulièrement dénoncés : c’est le thème de la chasse à la fraude. Bien sûr il y a des abus, mais imaginer les réduire et régler le problème des déficits par des contrôles accrus est totalement illusoire. Comment voulez-vous contrôler plus de deux millions de contrats conclus chaque année ? Il est, du reste, difficile de situer la frontière entre l’usage normal et l’usage abusif de liens récurrents d’emploi entre un employeur et un salarié intermittent. » La balle est désormais dans le camp du gouvernement : continuera-t-il à défendre cette « exception culturelle française » ou préférera-t-il céder aux normes libérales européennes ?
